Trade Secrets. A trade secret is a formula, practice, process, design, instrument, pattern, commercial method, or compilation of information which is not generally known or reasonably ascertainable by others, and by which a business can obtain an economic advantage over competitors or customers. The scope of trade secrets is virtually unlimited. Although IP enforcement and trade secrets are part of WIPO’s mandate, they occupy a very small policy-oriented role. The reason there is a WTO case dealing with IP theft is simply that there are no WIPO cases. WIPO, unlike the WTO, is relatively toothless. It cannot impose compensatory sanctions. Trade secrets are an important, but invisible component of a company's intellectual property (IP). Their contribution to a company's value, measured as its market capitalization, can be major. Being invisible, that contribution is hard to measure. The best way to protect an idea may be to keep it secret. Trade secrets may be used when an invention does not meet the patentability criteria or if an applicant does not wish to go through the patenting process which involves a disclosure process. Examples of trade secrets include the Coca-Cola recipe, customer lists or sales methods. Trade Secrets are the hidden forms of intellectual property that add value to a business.
